Welcome to sunpixies.com (the “Site”), the home of Sun Pixies from Dixie and the promotional site for SunnyJ, Tarot Reader (“SunnyJ,” “we,” “us,” or “our”). These Terms of Use (the “Agreement”) are a binding agreement between you and SunnyJ. By accessing or using the Site, or by requesting a reading with SunnyJ through the Keen platform, you accept and agree to be bound by this Agreement. If you do not agree, please do not use the Site or request a reading.

1.Eligibility

You must be at least eighteen (18) years of age, and legally able to enter into a binding contract, to use the Site or to request a reading with SunnyJ. By using the Site you represent and warrant that you meet these requirements. SunnyJ does not provide readings to minors, and does not knowingly collect information from anyone under 18. If you are under 18, please leave the Site.

The Site and SunnyJ's readings are not available to anyone whose Keen account has been suspended or terminated, or to anyone in a jurisdiction where such services are prohibited by law.

2.Entertainment purposes only

SunnyJ makes no promises about outcomes. Nothing said in a reading, shown on this Site, or written in any message from SunnyJ should be relied upon as a guarantee of any result, event, decision or timeframe. You are an adult. Whether and how you act on anything discussed in a reading is entirely your own choice and your own responsibility, and SunnyJ accepts no liability whatsoever for any decision you make or action you take, or fail to take, as a result of a reading or of anything on this Site.

SunnyJ holds an MA in Human Development & Psychological Counseling. That academic background informs how she listens; it does not make a reading a counseling session, a clinical service or professional advice of any kind. If you are in crisis, please contact your local emergency services or a crisis line straight away.

3.Readings happen on Keen

This Site is a promotional site. It describes SunnyJ's readings and links to her listings on Keen (keen.com), an independent third-party platform operated by Ingenio, LLC. SunnyJ does not sell, schedule, or deliver readings through this Site, and there is no way to pay for a reading here.

All readings with SunnyJ are conducted, timed and billed exclusively through the Keen platform, under Keen's own User Agreement and policies. By requesting a reading you agree to Keen's terms in addition to this Agreement. SunnyJ is an independent advisor on Keen; she is not an employee, agent or representative of Keen, and Keen does not endorse, verify, or guarantee her or this Site.

Consistent with Keen's rules:

• SunnyJ does not offer paid readings by any means outside Keen, including by email, text, social media, video call, direct payment, gift or “tip.” Please do not ask her to.
• SunnyJ will not ask you for your personal contact information, and you should not send her your phone number, email address, home address, social media handles, or payment details, whether through Keen or through this Site.
• Any email you receive from SunnyJ in connection with a reading is sent through the Keen platform. Links in those emails may point to pages and images on this Site.

Questions about billing, refunds, satisfaction guarantees, account access, or technical problems with a reading must be directed to Keen's customer support, not to SunnyJ. SunnyJ cannot issue refunds or adjust charges.

4.What a reading is, and isn't

SunnyJ offers tarot, love and relationship, spiritual, and otherworld-themed readings by phone and chat. In every reading, and consistent with Keen's User Services Rules, SunnyJ will not:

• diagnose any illness or condition, recommend or comment on medications or treatments, or offer anything that could be mistaken for medical, mental-health, dental or veterinary advice;
• give legal advice, or advice that requires a licence to give, including tax, accounting, insurance, real-estate or immigration advice;
• give financial or investment advice, recommend the purchase or sale of any security or cryptocurrency, or offer lottery, gambling or sports-betting guidance;
• cast, sell, or remove spells, curses, hexes, “negative energy” or similar, or claim to do so; or require you to buy candles, crystals or any other product;
• read for, about, or on behalf of a minor, or make predictions concerning a minor's safety or romantic life;
• promote any multi-level marketing, referral or investment scheme;
• record, transcribe or store any call or chat session; or
• use artificial intelligence to generate the content of a paid reading.

If a question strays into any of those areas, SunnyJ will say so and redirect the conversation. That is not a refusal of service; it is the boundary that keeps the reading honest, and it protects both of us.

5.Your responsibilities

You are solely responsible for the decisions you make and the actions you take following a reading, and for verifying anything important with an appropriate professional. You agree that you use the Site and any reading entirely at your own risk, that you have chosen SunnyJ as your advisor of your own free will through the Keen platform, and that you will not hold SunnyJ responsible for any consequence of that choice.

Where you contact SunnyJ by email (see Section 17), you agree to give accurate information, to keep the conversation courteous, and not to send anything unlawful, harassing, threatening, obscene or defamatory.

6.Prohibited conduct

You agree that you will not:

• record, transcribe, screenshot for publication, or otherwise store any reading, call or chat session with SunnyJ, in whole or in part;
• copy, scrape, frame, mirror, or reproduce the Site or its content, including SunnyJ's photographs, artwork, moon and season cards, written copy and the review wall, except as expressly permitted in Section 8;
• attempt to obtain SunnyJ's personal contact information, or that of any other Keen user, or attempt to arrange or pay for readings outside Keen;
• impersonate SunnyJ, Sun Pixies from Dixie, or any other person, or use the SunnyJ name, images or reviews to suggest an endorsement or affiliation that does not exist;
• post or submit reviews, feedback or ratings that you know to be false, or that you have been compensated to give;
• use the Site for any unlawful purpose, or in any way that could damage, disable, overburden or interfere with the Site or its hosting;
• use any robot, spider or automated means to access the Site for any purpose other than ordinary search-engine indexing; or
• upload or transmit viruses, malware or any other harmful code.

SunnyJ may decline or end a reading, and may block or report a user, at any time and in her sole discretion, including for any breach of this Agreement or of Keen's policies.

7.Reviews and testimonials

The Reviews page and other testimonials on this Site reproduce feedback that clients left for SunnyJ on Keen. Each is credited by the client's first initial or chosen Keen nickname only, together with the date it was given. Keen displays review text publicly for approximately one year; SunnyJ keeps a private record of her own review history and republishes reviews here after they have left Keen's public listing. Reviews may be lightly trimmed for length; their wording and meaning are not changed.

Reviews reflect the experience and opinion of the individual client who wrote them. They are not a promise that your reading will be the same. If you left a review on Keen and would prefer it not to appear here, email us (Section 17) with your Keen username and the wording of the review, and we will remove it.

8.Intellectual property

The Site and everything on it, including the Sun Pixies from Dixie name and tarot-card designs, the SunnyJ name as used for readings, all text, photographs, graphics, moon and season cards, audio, video, page layouts and code, are owned by SunnyJ or used under licence, and are protected by copyright, trademark and other intellectual-property laws.

You may view the Site, and you may save or print single copies of pages and images for your own personal, non-commercial use. You may also share links to Site pages and use standard social-sharing and pinning tools that link back to the Site. Any other use, including reproduction, modification, distribution, republication, commercial use, or the creation of derivative works, requires SunnyJ's prior written permission.

Keen and the Keen logo are trademarks of Ingenio, LLC. Their appearance on this Site is for identification only and does not imply any endorsement or affiliation.

9.Third-party sites and services

The Site links to Keen and may link to other third-party websites and services, including Pinterest, Google, and social-media platforms. Those sites are not controlled by SunnyJ, and SunnyJ is not responsible for their content, accuracy, security, availability or privacy practices. A link is not an endorsement. Your use of any third-party site is governed by that site's own terms and privacy policy, which you should read.

10.Disclaimer of warranties

THE SITE, ITS CONTENT, AND ALL READINGS AND OTHER SERVICES PROVIDED BY SUNNYJ ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH NO WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SUNNYJ DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY AS TO THE ACCURACY, RELIABILITY, COMPLETENESS OR TIMELINESS OF ANY READING, PREDICTION, INSIGHT, ADVICE OR CONTENT. SUNNYJ DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. READINGS ARE FOR ENTERTAINMENT PURPOSES ONLY, AND ANY RELIANCE YOU PLACE ON THEM IS STRICTLY AT YOUR OWN RISK.

11.No liability; release of claims

YOU AGREE THAT SUNNYJ HAS NO LIABILITY TO YOU OF ANY KIND ARISING OUT OF OR RELATING TO THIS AGREEMENT, THE SITE, ANY READING, OR ANY DECISION OR ACTION YOU TAKE OR FAIL TO TAKE AFTER A READING. WITHOUT LIMITING THAT, IN NO EVENT WILL SUNNYJ BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, RELATIONSHIPS, HEALTH OR OPPORTUNITY, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT ANY LIABILITY IS NONETHELESS FOUND TO EXIST, SUNNYJ'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID FOR READINGS WITH SUNNYJ THROUGH KEEN IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) TWO HUNDRED US DOLLARS (US$200).

RELEASE. BY USING THE SITE OR REQUESTING A READING, YOU KNOWINGLY AND VOLUNTARILY RELEASE, WAIVE AND DISCHARGE SUNNYJ FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES AND CAUSES OF ACTION, KNOWN OR UNKNOWN, ARISING OUT OF OR RELATING TO ANY READING OR TO YOUR USE OF THE SITE, AND YOU COVENANT NOT TO SUE SUNNYJ IN RESPECT OF ANY OF THEM.

12.Indemnification

You agree to indemnify, defend and hold harmless SunnyJ from and against any and all claims, demands, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or relating to your use of the Site or of any reading, your breach of this Agreement, your violation of Keen's terms or of any law, or your infringement of the rights of any third party.

13.Copyright complaints

SunnyJ respects the intellectual property of others. If you believe that material on the Site infringes a copyright you own or control, please email hello@sunpixies.com with: a description of the copyrighted work; the URL of the material you believe is infringing; your contact details; a statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law; a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorised to act for the owner; and your physical or electronic signature. Material found to be infringing will be removed.

14.Governing law and dispute resolution

This Agreement, and any dispute or claim arising out of or relating to it, the Site, or any reading, is governed by the laws of the State of Nevada, United States of America, without regard to its conflict-of-law rules. The exclusive venue for any proceeding that is not subject to arbitration under this Section is the state and federal courts located in Reno, Washoe County, Nevada, and you consent to the personal jurisdiction of those courts.

Talk to us first. If you have a concern, email hello@sunpixies.com and we will make a good-faith effort to resolve it informally within thirty (30) days. Disputes about payment, billing or refunds for a Keen reading are subject to Keen's own dispute process and must be raised with Keen.

Binding individual arbitration. Any dispute that cannot be resolved informally, including any dispute about the scope or enforceability of this Section, will be resolved by final and binding arbitration before a single neutral arbitrator, rather than in court, except that either party may bring an individual claim in small-claims court, and either party may seek injunctive or other equitable relief in court to protect intellectual-property rights. The arbitration will be administered by a recognised arbitration provider under its rules for consumer disputes, and will take place, at the claimant's option, by telephone, video, written submissions, or in person in Reno, Nevada. The arbitrator's award may be entered in any court of competent jurisdiction. Each party bears its own attorneys' fees and costs unless applicable law or the arbitration rules provide otherwise.

CLASS ACTION WAIVER. YOU AND SUNNYJ AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS.

15.Changes to this Agreement

SunnyJ may revise this Agreement from time to time. The current version will always be posted on this page with its “last updated” date. Changes take effect when posted, and your continued use of the Site or of readings after that date means you accept the revised Agreement. Material changes will be highlighted at the top of this page for at least thirty (30) days.

16.General provisions

Entire agreement. This Agreement, together with our Privacy Policy, is the entire agreement between you and SunnyJ concerning the Site. Your readings on Keen are additionally governed by Keen's User Agreement and policies; in the event of a conflict concerning a reading on Keen, Keen's terms control as between you and Keen.

Severability. If any provision of this Agreement is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force.

No waiver. SunnyJ's failure to enforce any right or provision is not a waiver of that right or provision.

Assignment. You may not assign or transfer this Agreement without SunnyJ's prior written consent. SunnyJ may assign it freely.

Independent parties. No agency, partnership, joint venture, or employment relationship is created between you and SunnyJ, or between SunnyJ and Keen, by this Agreement or by your use of the Site.

Electronic communications. You agree that agreements, notices and other communications provided electronically satisfy any legal requirement that they be in writing.

Notices. Notices to SunnyJ must be sent in writing by email to hello@sunpixies.com. Notices to you may be posted on the Site or sent through Keen.
